The Terms and Conditions of Sale contain the provisions and requirements of sale for purchasing from LDS&S. Placement of an order shall be deemed acceptance of the Terms and Conditions of Sale. LDS&S reserves the right to modify or amend its Terms and Conditions of Sale at any time, and from time to time, and for any reason. Any changes to the policy will be posted on this site, although LDS&S reserves the right to post these changes in a timely manner, or to post them at all on this site.

All sales, orders, or intent to purchase constitutes the Buyer’s agreement to the terms and conditions as stated below.
ORDERING PROCEDURES
1) Please call or email your orders NO LATER than 2:pm the day prior to your delivery day or for orders to ship the next business day.
2) Cancellation of special orders and/or non-stock material will NOT be accepted. Non-stock and special order items may be subject to payment prior to order.
A written purchase order or confirmation will be required.
3) Minimum qualifying order to establish a new account will be $200.00
4) All pricing, and terms & conditions are subject to change without notice.
FREIGHT & DELIVERY POLICY
1) Freight shipped on LDS&S trucks will be assessed a $35.00 delivery charge. Common carrier shipments are F.O.B. Sussex, WI and will assessed a $20.00
shipping & handling charge plus all freight charges including but not limited to shipping, handling, pallet and/or box charges. FedEx or SpeeDee shipments are
subject to a $7.00 shipping & handling charge, plus applicable freight charges. C.O.D. fees are charged if applicable on any shipment. Some materials require
are subject to special carton fees for each carton required in addition to regular charges.
2) Customer assumes responsibility for any damages or shortages on carriers other than LDS&S. Any damages or shortages should be noted and signed for on the
delivery copy via our truck. Any damages or shortages must be noted on the carriers BOL or other paperwork for carrier orders, and the customer must make
their claim immediately as we are unable to make a claim for you. We will assist whenever possible.
3) Pick up at our Sussex facility—Monday through Friday—8:00 am to 4:00 pm.
TERMS/CREDIT/PAYMENTS
1) Cash, Check, ACH, Credit Card (credit cards will incur a 2% processing fee). Wire transfer service fee $15.00

A 1.5% finance charge will be applied on past due accounts, beginning the second month. Failure to comply with these terms may subject an account to C.O.D.
terms. Customer shall be liable for reasonable attorney’s fees required to collect on past due accounts. All orders are subject to approval by our credit department.
Our fee for a check returned unpaid by a bank is $35.00.
RETURN POLICY
1) No merchandise may be returned without prior written permission. We reseve the right to inspect material to be returned before issuing return authorization.
Returns other than shipping error or defective goods are subject to the following minimum handling/restocking charges based on the amount of time elapsed
between the invoice date and the request to return: up the months @ 25%; 4-6 months @ 50%; 6+ months from date of purchase will not be accepted for return,
and no credit will be given.
2) MTO special order or non-stock items will be subject to the specific manufacturer’s return policy. NOTE: depending on the product and vender, special orders
and non-stock items may not be returnable under any circumstances.
3) Obsolete, discontinued, or close—out items are not returnable.
4) Customer is responsible for proper packing and protection of all return shipments. Credit will be issued on merchandise returned in saleable condition, in origi-
nal packaging, and after imspection of the material.
5) Do not deduct from your account or remittance until formal credit is given.
PERFORMANCE
1) We are not liable for delays due to matters unavoidable and beyond our control including but not limited to strikes, fire, accidents, or weather related setbacks.
2) Shipping and delivery dates are estimates based on information received from our suppliers and shall not be deemed guaranteed.
RESPONSIBILITY
Our liability is limited to the manufacturer’s warranties. We are not liable for any indirect, incidental, or consequential damage or injury to the
person(s) or property of the Buyer or others.
